THE FOLLOWING TERMS AND CONDITIONS GOVERN YOUR ACCESS TO, AND USE OF OUR SERVICES AND WEB SITE. PLEASE READ THEM CAREFULLY AND BE SURE YOU UNDERSTAND BEFORE PROCEEDING.

1. Agreement: These terms and conditions constitute a legally binding agreement between you, the player or visitor, and Online Ticket Services LLC. By clicking the "Accept" icon, you are affirming that you fully understand and will comply with all of Lotto-Taxi’s terms and conditions. This includes instructions, policies, limited liability and warranty, and other guidance, as they now exist and as they may be updated from time to time. Terms and Conditions apply to all visitors whether or not you actually register or purchase tickets; and you must agree to them in order to make any ticket purchases through us. This Agreement is made, and will be governed by and construed according to the laws of Colorado. In the event of litigation arising from your visitation to or use of this site, you acknowledge the exclusive jurisdiction of the courts of the State of Colorado.
2. Who May use our services: With the exception of the parties named below, any legally competent adult may register, set up an account, and use our services. You are solely and exclusively responsible for complying with the applicable laws where you reside, including but not limited to, those concerning gambling, the age of majority, legal competence, currency exchange, and taxes.
   1. Amusement Only: Purchase of Powerball tickets via Lotto-taxi is for private amusement only and any other use of the site is specifically and expressly forbidden
   2. Exceptions: Employees of Lotto-taxi and its affiliates, including their immediate family members, are not eligible to set up accounts or purchase tickets.
3. Registration and Account: You must register and open an account with Lotto-taxi, only individual persons may open accounts; no more than one account per person. An account may only be used by the person to whom it is registered. Allowing anyone else to use your account, or holding multiple Lotto-taxi accounts, is cause for immediate termination. Lotto-taxi in its sole discretion may terminate the account of any player if the registrant’s name does not match the name on the credit card or other instrument offered for account deposit.
   1. Payment: Payment is due each time you submit an order. Sales are final; you understand that we cannot refund the money for any ticket we buy on your name. Tickets are not refundable to us, and consequently they cannot be refundable to you.
   2. No Commissions: Lotto-taxi will not take any commission or percentage of any winnings. All winnings belong to the ticket purchaser.
   3. User name and password: We will issue you a user name and allow you to set your personal password. You must not allow anyone else to know them or use them. Violation is cause for terminating your account without notice. If your user name or password is lost, stolen, or compromised, you must contact Customer Support immediately.
   4. Privacy: When registering on our site, it is your responsibility to provide accurate information and to keep it current. Giving false or misleading information is cause for terminating your account.
      1. Personal information: Your personal information, such as name and address will be required to allow you to use credit cards and similar instruments to deposit with us. Your personal information will be stored and safeguarded with the same measures and encryption we use for our own.
      2. Participatory data: we will keep track of your patterns and history of play in order to protect you and other players against intrusion and fraud. This information will also be safeguarded by us. We recommend you keep records of your ticket purchases receipts as well.
      3. Email: we may keep the text of your email communications with us, and will ask permission to notify you of tournaments, promotions, and other matters of interest to you.
      4. Security: To protect you and the other players, Lotto-taxi may ask you at any time to confirm your identity and verify your financial transactions. You therefore authorize Lotto-taxi and its agents to make any necessary inquiries, including credit reports, contacting third parties, and database searches. You further agree to provide any necessary proof of your identity, especially when receiving any winnings. Failure to cooperate with security inquiries, including necessary authorizations, is grounds for terminating your account.
   5. Funds: Payment in full is expected for each order, via a method authorized by Lotto-taxi. Funds are not insured and no interest will be paid. Deposits and payouts shall be only in those currencies authorized by Lotto-taxi.
   6. Selection and Purchase
      1. Agency: By opening an account you appoint Online Ticket Services, LLC (including its affiliates) your agent for the sole purpose of purchasing and holding lottery tickets in your name.
      2. Selection: For any ticket or group of tickets purchased, you may choose the numbers to play, or use the Lotto-taxi Random Generator mode. Particular procedures are provided in the “How To” portion of the Lotto-taxi web site.
      3. Transmission and Receipt: All numbers chosen for play must be submitted and payment clear by Lotto-taxi no less than 8 hours before the scheduled drawing. Lotto-taxi will send you confirming email with all your tickets details.
      4. Records and retention: We will retain each ticket bought at our offices in Colorado for a period of one full year following date of purchase.
      5. Withdrawals: You may withdraw funds from your account at any time, up to the amount of your balance.
         1. Lotto-taxi may be required by law to withhold and report any amount required by law from your balance and winnings
         2. Lotto-taxi will send your payments to you as quickly as we can. You can withdraw funds using any of the following methods: (1) check (domestic accounts), (2) wire transfer (international customers). In all cases the fees associated to the transaction are your responsibility. Fees for each of the methods are different so before we can transfer you we need to retain payment for the withdrawal.
      6. Processors: Lotto-taxi uses third party payment processors to handle its financial transactions. By transferring funds to your Lotto-taxi account, you irrevocably authorize Lotto-taxi to instruct the processors to handle cash processing transactions (both deposits and payouts) on your behalf from your account. Transactions are subject to the processors’ respective terms and conditions, but if there is a conflict between them and this Agreement, then this Agreement is controlling.
4. Limitation of Liability and Warranty: These limits shall apply to any and all applicable legal theories of recovery or causes of action.
   1. No Warranty: Lotto-taxi makes no warranty, express or implied, as to the fitness for use of any of its services, including, without limitation, compatibility with user computers, browsers, or other software; or merchantability.
   2. Interruptions and Interference: Site service is available on an “as-is, as available” basis. Lotto-taxi will not be liable for interruption or partial interruption of services to players or visitors, interception of data, or other malfunctions including those caused by failure of service from any cause. Lotto-taxi will not be liable for damage to your computer, server, software, peripherals of other equipment by viruses, worms, Trojan horses, Denial of Service attacks or other invasive and disruptive programs or measures by any party whatsoever, connected with or traceable to, your accessing of our site.
   3. No Third Party Liability: In no circumstances whatsoever will Lotto-taxi be liable to any third parties for any harm, damage, or loss traceable to or associated with its provision of services via its web page.
   4. Limitation of Remedy: Your remedies, if any, will be limited to damages directly and proximately caused by reasonable reliance on the services provided by this site, not to exceed an amount equal to that deposited during the calendar month the incident in question occurred.
   5. No Consequential Damages: In no event whatsoever will Lotto-taxi be liable to you or any third party for any consequential, indirect, or special damages of any description arising from your visitation to or use of our site; including but not limited to, lost profits, loss of privacy, failure of duty including good-faith; whether or not arising from Lotto-taxi’s breach of terms, fault, tort, negligence, or strict liability.
5. Indemnification: If your access to and use of our site (including, without limitation: entering the site, purchasing tickets, accepting prizes, or violating the Terms and Conditions) causes any damage, loss, or gives rise to liability or claim against Lotto-taxi by third parties, you will be required to hold harmless and indemnify Lotto-taxi against those damages, losses or claims.
6. Basics rules of using the Lotto-taxi Site:
   1. Conduct of visitors and players: When using the site services, including chat rooms, you agree to observe basic standards of courtesy. Abusive, indecent or disruptive language or messaging is cause for removal from the site and termination of your account.
   2. Our Service policy:
      1. Lotto-taxi at its sole discretion may allow, or limit or refuse any service request made by any player.
      2. You are solely and exclusively responsible for all transactions made using your user name and password, whether you were the one who made it or not.
   3. Controlling results: The Official Powerball results will be final and binding.
   4. Disputes: If the results are still in dispute, or for any other conflict between you and Lotto-taxi you agree to submit to binding arbitration in the State of Colorado.
   5. Cheating and other misconduct: Lotto-taxi, at its sole and exclusive discretion, may invalidate any purchase and immediately withdraw the balance of your accounts with us (including processor accounts) for any of these reasons:
      1. Cheating or collusive playing with another player or players.
      2. Tamper or try to modify the numbers used.
      3. Chargeback or otherwise attempting to invalidate properly made purchases on the Lotto-taxi web site.
      4. Lotto-taxi reserves the right to publicize the identity of anyone attempting to cheat or defraud Lotto-taxi or other players.
   6. Non-use and abandonment: If for any reason you do not use your account for a period of more than one year; Lotto-taxi will attempt to contact you and determine if you wish to continue with us. If we cannot contact you, your account will be deemed abandoned and any remaining balance (including processor accounts) will be withdrawn and your username and password invalidated.
   7. Selecting numbers: Every time you as user submit an order, you accept full ownership of the numbers selected for that order, independently of the method you use to do so.
   8. Accepting numbers: Before placing any order, the user must review all the numbers he/she wishes to use for it. By clicking in "Submit order" button the user is acknowledging the fact he/she pick the numbers for each one of the entries in the order.
7. General Provisions
   1. You may not transfer or assign any of your rights under these Terms.
   2. If Lotto-taxi should forbear to exercise any of its rights or powers under these Terms, that does not mean Lotto-taxi has waived them, and they continue in force.
   3. If a court of competent jurisdiction should find any provision in these Terms to be invalid, that item will be deleted but the rest of the Terms remain in force. Lotto-taxi, however, at its sole and exclusive discretion, may consider the loss of a particular provision or provisions to have made the agreement unenforceable or incapable of performance. In that case this agreement automatically terminates forthwith.
   4. These terms are the complete and final agreement between you and Lotto-taxi. They supersede and override all previous agreements or understandings about using Lotto-taxi’s services and web page.
